Our services may include, but are not limited to:

Paid advertising strategy and management
Google, Facebook, YouTube, Meta, TikTok, or other digital ad campaigns
Landing pages, funnels, tracking, and lead capture systems
CRM, automation, and follow-up support
Market exclusivity opportunities
Consulting, coaching, and campaign optimization
Lead delivery, reporting, and marketing performance insights
The exact services provided to each Client will be determined by the applicable order form, proposal, invoice, statement of work, service agreement, or written agreement between the parties.
3. Eligibility
Our services are intended for experienced real estate investors, wholesalers, business owners, and professionals who understand the risks involved in marketing, sales, real estate investing, and lead follow-up.
By using our website or services, you represent that:
You are at least 18 years old.
You have the authority to enter into these Terms.
You are using our services for lawful business purposes.
You will comply with all applicable federal, state, and local laws.
You will not use our leads, systems, content, or services for fraudulent, deceptive, abusive, or illegal purposes.
We reserve the right to refuse service, reject applications, deny access, cancel accounts, or terminate services at our discretion.
4. No Guarantee of Results
Lead House 365 provides marketing and lead generation services. However, we do not guarantee any specific financial outcome, number of closed deals, revenue amount, profit, return on ad spend, contract rate, appointment rate, conversion rate, or business result.
You understand and agree that results may vary based on many factors, including but not limited to:
Your market
Your offer
Your budget
Seller motivation
Competition
Economic conditions
Real estate market conditions
Follow-up speed
Sales skills
Negotiation skills
Lead handling process
Availability of capital
Your ability to close transactions
Advertising platform performance
Compliance with our recommendations
Any examples, testimonials, case studies, earnings claims, lead counts, conversion rates, or performance results shown on our website, social media, sales materials, or presentations are for illustrative purposes only and do not guarantee that you will achieve the same or similar results.
You are solely responsible for evaluating and acting on each lead, negotiating with sellers, performing due diligence, complying with applicable laws, and completing any real estate transaction.
5. Lead Quality and Lead Delivery
Lead House 365 may generate leads through paid advertising, online forms, landing pages, inbound marketing, tracking systems, or other digital marketing methods.
A “lead” may include information submitted by a prospective seller, homeowner, property owner, or other individual who expresses interest in selling a property or receiving more information.
You understand that:
A lead is not a guaranteed deal.
A lead is not a guaranteed appointment.
A lead is not a guaranteed contract.
A lead is not a guaranteed sale.
A lead may require repeated follow-up.
A lead may contain inaccurate, incomplete, outdated, or unverified information.
Sellers may change their minds, become unavailable, reject offers, or choose another buyer.
Lead House 365 does not guarantee that any lead will result in a signed contract, assignment fee, wholesale deal, purchase, sale, commission, or profit.
6. Client Responsibilities
As a Client, you are responsible for:
Contacting leads promptly.
Following up consistently and professionally.
Maintaining accurate records.
Using leads only for lawful business purposes.
Complying with all real estate, marketing, privacy, consumer protection, telemarketing, and advertising laws.
Verifying property details and seller information independently.
Obtaining any required licenses, permits, contracts, disclosures, or approvals.
Ensuring your sales scripts, offers, contracts, and business practices are lawful.
Honoring all payment obligations to Lead House 365.
Providing accurate onboarding information, market details, business details, and campaign assets.
Lead House 365 is not responsible for your failure to follow up with leads, close deals, answer calls, respond to sellers, manage your CRM, comply with applicable laws, or operate your business effectively.
7. Market Exclusivity
Lead House 365 may offer market exclusivity to certain Clients, subject to availability, approval, payment, and written confirmation.
Market exclusivity means that Lead House 365 agrees not to knowingly provide the same defined lead generation service to another direct Client in the same agreed-upon market during the applicable exclusivity period.
Market exclusivity does not mean:
You own the market.
No other investor can advertise in the market.
No other company can generate leads in the market.
Sellers will only contact you.
Advertising costs will remain fixed.
Lead volume is guaranteed.
Results are guaranteed.
Market exclusivity must be confirmed in writing by Lead House 365. We reserve the right to define the size, scope, boundaries, zip codes, counties, cities, radius, or service area of each exclusive market.
Failure to make timely payments may result in the loss of market exclusivity.
8. Advertising Accounts and Platform Rules
Lead House 365 may manage or assist with advertising campaigns on third-party platforms such as Meta, Facebook, Instagram, Google, YouTube, TikTok, or other advertising networks.
You acknowledge that third-party platforms have their own rules, policies, algorithms, review processes, billing systems, and restrictions. Lead House 365 does not control these platforms and is not responsible for:
Ad disapprovals
Account suspensions
Policy changes
Increased ad costs
Tracking limitations
Algorithm changes
Platform outages
Billing errors by third-party platforms
Reduced campaign performance caused by platform changes
You agree to comply with all applicable platform policies and to provide accurate business information when required.
9. Ad Spend
Unless otherwise stated in writing, advertising spend is separate from Lead House 365’s management fees, service fees, setup fees, consulting fees, software fees, or retainers.
You are responsible for all approved advertising spend, media spend, platform charges, and related costs.
Lead House 365 may make budget recommendations, but you are ultimately responsible for approving, funding, and maintaining your advertising budget.
Ad spend paid directly to third-party platforms is generally non-refundable.
10. Fees, Payments, and Billing
By purchasing services from Lead House 365, you agree to pay all fees listed in your invoice, order form, proposal, checkout page, service agreement, or written agreement.
Fees may include, but are not limited to:
Setup fees
Monthly retainers
Management fees
Lead generation fees
Consulting fees
Software fees
Funnel fees
Automation fees
Creative fees
Media buying fees
Performance-based fees, if applicable
Payment terms will be determined by your applicable agreement or invoice. Unless otherwise stated in writing, fees are due in advance.
You authorize Lead House 365 or its payment processors to charge your selected payment method for all fees owed.
Late payments may result in paused campaigns, suspended lead delivery, loss of market exclusivity, late fees, collection activity, or termination of services.
11. Refund Policy
Unless otherwise stated in a signed written agreement, all payments to Lead House 365 are non-refundable.
This includes, but is not limited to:
Setup fees
Retainers
Management fees
Consulting fees
Software fees
Campaign fees
Lead generation fees
Creative fees
Completed work
Work already started
Advertising strategy
Funnel setup
Campaign setup
Time allocated to your account
Because marketing services involve strategy, labor, setup, campaign management, creative development, media buying, testing, and platform costs, we do not offer refunds for services already rendered, time reserved, or work performed.
Any refund, credit, pause, or replacement lead policy must be agreed to in writing by Lead House 365.
12. Cancellation
Cancellation terms will be governed by your applicable invoice, order form, proposal, service agreement, or written agreement.
Unless otherwise stated in writing, Clients must provide written notice before cancellation. Cancellation does not relieve you of responsibility for any unpaid fees, ad spend, approved expenses, or amounts already owed.
Lead House 365 may cancel or suspend services if:
You fail to pay on time.
You violate these Terms.
You misuse leads.
You engage in unlawful or unethical conduct.
You fail to provide required information.
You interfere with campaign performance.
You damage our reputation or business relationships.
We determine that continuing the relationship is no longer appropriate.
13. Chargebacks and Payment Disputes
You agree to contact Lead House 365 first to resolve any billing concern before initiating a chargeback or payment dispute.
If you initiate a chargeback for a valid payment, we reserve the right to:
Suspend services
Terminate your account
Stop lead delivery
Revoke market exclusivity
Recover collection costs
Recover legal fees
Provide documentation to the payment processor
Decline future service
You remain responsible for all amounts owed, including any chargeback fees, collection costs, and reasonable attorney’s fees.
14. Client Content and Materials
You may provide Lead House 365 with business information, logos, photos, videos, testimonials, sales scripts, branding materials, market information, CRM access, ad account access, or other content.
By providing materials to Lead House 365, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, distribute, and modify those materials solely for the purpose of providing services to you.
You represent that you have the right to provide these materials and that our use of them will not violate any third-party rights.
You are responsible for ensuring that your claims, testimonials, offers, photos, videos, contracts, scripts, and business representations are accurate, lawful, and not misleading.
15. Use of Testimonials, Case Studies, and Results
Unless you request otherwise in writing, you grant Lead House 365 permission to reference your business name, results, testimonials, feedback, screenshots, messages, reviews, or general campaign performance in our marketing materials, case studies, sales presentations, website, social media, or advertisements.
We may use testimonials and results in a truthful and non-misleading manner. We may edit testimonials for clarity, length, grammar, or formatting, provided the meaning is not materially changed.
If you do not want your business name, likeness, testimonial, or results used publicly, you must notify us in writing.
16. Communications Consent
By submitting a form, booking a call, requesting information, applying for services, or otherwise providing your contact information to Lead House 365, you agree that Lead House 365 and its representatives may contact you by phone, text message, email, direct message, voicemail, or other communication methods.
You understand that communications may include marketing, sales, service updates, appointment reminders, follow-up messages, and other business-related communications.
You also understand that calls or messages may be sent using automated technology, prerecorded messages, artificial intelligence, or other communication systems where permitted by law.
Message and data rates may apply. Consent to receive marketing communications is not a condition of purchase. You may opt out of marketing text messages by replying STOP or by contacting us directly.
You agree to provide accurate contact information and not to submit contact information for another person without permission.
17. Client Compliance With Call, Text, Email, and Marketing Laws
If you contact, call, text, email, mail, or otherwise communicate with any lead provided through Lead House 365, you are solely responsible for complying with all applicable laws and regulations, including but not limited to:
Telephone Consumer Protection Act
CAN-SPAM Act
Telemarketing Sales Rule
State telemarketing laws
Do-not-call rules
Consumer privacy laws
Real estate advertising laws
Fair housing laws
State licensing laws
State-specific wholesaling laws

Lead House 365 does not provide legal advice and does not guarantee that your use of any lead, script, CRM, phone system, dialer, SMS platform, email tool, contract, or sales process complies with applicable law.
You should consult your own attorney regarding your legal obligations.
18. Prohibited Uses
You agree not to:
Use our website or services for illegal purposes.
Misrepresent your identity, company, licensing, or qualifications.
Harass, abuse, threaten, deceive, or exploit sellers.
Use leads for spam, fraud, phishing, or unlawful solicitation.
Resell, transfer, publish, or distribute leads without written permission.
Scrape, copy, reverse engineer, or steal our systems, funnels, copy, ads, landing pages, processes, or intellectual property.
Upload malicious software or interfere with our website.
Violate advertising platform rules.
Make false claims about Lead House 365.
Use our brand, name, logos, content, or materials without permission.
Circumvent payment obligations.
Share confidential information without authorization.
Engage in conduct that harms our business, reputation, Clients, partners, vendors, or systems.
Violation of this section may result in immediate termination without refund.
19. Intellectual Property
All content, materials, systems, methods, frameworks, copy, designs, advertisements, funnels, landing pages, videos, graphics, logos, trademarks, service marks, scripts, trainings, documents, processes, strategies, software, and other intellectual property provided by Lead House 365 are owned by Lead House 365 or its licensors.
You may not copy, reproduce, modify, distribute, sell, license, publish, or create derivative works from our materials without written permission.
You receive a limited, revocable, non-transferable license to use materials provided to you only for the purpose of receiving services from Lead House 365.
20. Confidential Information
During the course of working together, either party may receive confidential or proprietary information.

Campaign data
Client lists

Pricing

21. Data, Privacy, and Lead Information

You agree to use all lead data lawfully, responsibly, and only for legitimate business purposes related to your real estate investing or approved business activities.

Advertising platforms will approve ads.
Services will meet every expectation.
Any particular seller will transact with you.
Any lead will become a deal.
27. Limitation of Liability
To the fullest extent permitted by law, Lead House 365 shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages arising out of or related to your use of our website, services, leads, content, campaigns, or materials.

Lost profits
Lost revenue
Lost deals
Lost opportunities
Lost data
Business interruption
Advertising platform issues
Seller disputes
Failed transactions
Compliance violations by Client
Third-party claims
Market changes
To the fullest extent permitted by law, Lead House 365’s total liability for any claim shall not exceed the amount you paid to Lead House 365 for services during the three months immediately preceding the event giving rise to the claim.
28. Indemnification
You agree to defend, indemnify, and hold harmless Lead House 365, its owners, employees, contractors, representatives, affiliates, vendors, and partners from and against any claims, damages, losses, liabilities, costs, penalties, fines, and expenses, including reasonable attorney’s fees, arising out of or related to:

Your use of any leads
Your communications with sellers
Your real estate transactions
Your breach of these Terms
Your violation of any law or regulation
Your advertising claims or business practices
Your misuse of lead data
Your failure to obtain required licenses or disclosures
Your negligence, fraud, or misconduct
29. Termination
We may suspend or terminate your access to our website, services, campaigns, lead delivery, market exclusivity, or account at any time if we believe you have violated these Terms or engaged in conduct harmful to Lead House 365, our Clients, vendors, partners, or the public.
Upon termination, all outstanding fees become immediately due. You must stop using any confidential information, proprietary materials, systems, or access provided by Lead House 365 unless otherwise agreed in writing.
30. Dispute Resolution
Before filing any legal action, you agree to first contact Lead House 365 in writing and attempt to resolve the dispute informally.
If the dispute cannot be resolved informally, the parties agree to resolve the matter through binding arbitration, unless prohibited by applicable law.
Any arbitration shall take place in Orange County Florida, unless the parties agree otherwise in writing.
Each party shall bear its own attorney’s fees and costs unless otherwise required by law or awarded by the arbitrator.
31. Class Action Waiver
To the fullest extent permitted by law, you agree that any dispute with Lead House 365 must be brought on an individual basis only.
You agree not to participate in any class action, collective action, private attorney general action, or representative proceeding against Lead House 365.
32. Governing Law
These Terms shall be governed by and interpreted according to the laws of the State of Florida, without regard to conflict-of-law principles.
Any legal action not subject to arbitration shall be brought in the courts located in Orlando, FL, and you consent to personal jurisdiction in those courts.
